Campaign to spread out its activation across 7 states, 25 districts and 3 cities

Its constant endeavour to strengthen Hon’ble Prime Minister’s Swachh Bharat Mission, RB in collaboration with Jagran Pehel today marked the success of their 1st phase of activation in Uttar Pradesh and Bihar, successfully reaching out to 200 Villages and 85,205 Households The 2nd Phase of the campaign would target 26,032 Villages and 14,712,453 Households across 7 Indian states of UP, Bihar, Rajasthan, Gujarat, Maharashtra, Telangana and Andhra Pradesh covering 25 districts and 3 cities.

As a part of the initiative, The BSI Campaign in the second phase will focus on mentoring Swachh Bharat Fellows who will provide support to districts in smooth implementing and monitoring of the mission They would work closely with faith based leaders, mothers, care givers, municipal cleaners on behavioural Change Communication and also initiate citizen movement for Human to Human connect. The Campaign which was launched in 2015, has been successful in reaching out to 100% of its target and has successfully mobilised around 13000 change leaders in communities.

The announcement was made in Lucknow at the completion of 1st phase of “Changing Behaviour, Creating Sanitation Change Leaders programme” in association with Jagran Pehel. The event brought together leaders and policy makers from Global Interfaith WASH Alliance, WHO, UNICEF, World Toilet Organisation and other organisations associated with Dettol Banega Swachh India to share best practices and grassroots solutions that can be implemented to achieve Open Defecation Free status.

Chief Guest Shri Surya Pratap Shahi, Cabinet Minister for Agriculture, Agriculture Education and Agricultural Research launched the Impact Assessment Report that embodies behaviour change strategies adopted, activities undertaken, success stories and impact created through public-private participation during the first year of  the project. GST Impact on the Health Care Industry- Two Sides of a Coin.

Chennai: 07, July, 2017: The World’s largest democracy has adopted a new tax regime- The Goods & Service Tax. This being a radical shift from the existing tax regime, the government of Indiahas kept in mind a smooth and flawless transition by not raising or reducing the existing tax rate on goods and services too drastically. It was also agreed to keep the existing list of items that are exempt from taxes intact in the new regime. Healthcare, hence, found itself on the exemptions list again even under the new regime.

But there exist two sides of a coin. Similarly, though the health care services are exempt on one side, the inputs used to provide such health care services are now taxed under the 12% tax bracket in total contrast to the old tax bracket of 2% -5.5%. Subsequently, the cost of surgeries and other medical procedures that involve use of such inputs, will now go up considerably.

Secondly, Housekeeping services and Security services which are essential to the healthcare sector are also now taxed at a higher rate of 18%. An increase in the rate of these services lead to increase in the day to day operating costs of any health care establishment.

Thirdly, ancillary medical procedures and diagnostics including reagents, which play a key role in treatment, have been put under the 12 percent and 18 percent slab. This means, cost of diagnostic services will go up considerably.

Until now, life-saving drugs that treat diseases like malaria, HIV-AIDS, tuberculosis, and diabetes, had been exempted from excise and customs duties. But GST has now slotted them compulsorily under the five percent slab, while categorizing formulations into the 12 percent slab (up from nine percent).

As a result of all the above, the increase in the input costs to the hospitals have only one way out. They have to be passed onto the end customers i.e. the patients. The only relief is that luxury tax on room charges has been subsumed into GST and hence, patients will no longer be charged a separate luxury tax.

Hence, the overall cost of healthcare will increase as tax on inputs of hospitals including equipment, accessories and services such as maintenance of equipment and labourcontracts, will rise. But the positive aspect of GST is that, there will exist a seamless input tax credit system, which shall pose like a boon in spite of all the enhanced costs.

Chennai: July, 2017, will forever be etched as a landmark day in the history of Indian sports as it witnessed the Hon’ble Prime Minister of India, Shri Narendra Modi, inaugurate the most advanced integrated sports stadium in the world, ‘The Arena by TransStadia’ in Ahmedabad, Gujarat, India’s first and only successful Public Private Partnership for Urban Sports Infrastructure.

The PM reviewed the stadium, its facilities and operations accompanied by Harish Sheth, Chairman and Udit Sheth, Managing Director of SE TransStadia. The PM first visited and inaugurated the state-of-the-art TransStadia Sports Performance and Rehab Centre that aims to build a strong and healthy India through its human performance labs, non-invasive treatment, assessments and tailor-made fitness programs. The assessment and training equipment at the centre is available for the first time in India – Pro Reaction Timer, Swift SpeedLight, Touch Mat/Speed Mat and more. He also visited the mobile medical van that is equipped with specialized doctors to test and guide children across the country, giving them insights to different sports best suited to their skills. The sports science centre offers maximum relief and medication to injured individuals and also sportspersons that demand the highest level of fitness.

He also visited the spacious children’s play area. Supporting this event with their presence were India’s finest sports superstars and legends – ace badminton coach Pullela Gopichand; Olympians Srikanth Kidambi, Gagan Narang, Sushil Kumar; Paralympian Deepa Malik; former Indian kabaddi captain Anup Kumar; ex-Indian football captain Bhaichung Bhutia, and Indian cricketers Irfan Pathan and Parthiv Patel, both having played domestic cricket for their home state of Gujarat.

As he arrived on the football pitch amongst a frenzied audience, Hon’ble PM was introduced to the various global patented technologies incorporated at the Arena, including T-Box seating and StadiArena, that converted into an indoor arena with a click of a button by the PM within minutes unveiling the stage. The Hon’ble PM was welcomed by the CM of Gujarat Shri Vijay Rupani and Deputy CM of Gujarat Shri Nitin Patel along with other dignitaries. Shri Narendra Modi felicitated sportspersons of Gujarat, which supports players capable of winning medals at the international level and addressed a crowd of over 16,000 that included young athletes, coaches, principals and students.

Away from Patents, Indian PPVFR Act protects Breeders and Farmers Rights

India as a sovereign nation has chosen the Sui generis option for protection of Plant varieties in line with its obligation to meet the article 27.3(b) of TRIPS (Trade related intellectual property rights) agreement of WTO (World Trade organization). Balancing the national interest with international trade obligations, India has adopted a unique framework of a special kind, outside the known IPR framework (eg: patents), in the form of Protection of Plant Varieties and Farmers Rights act, 2001 or PPVFRA act.

The preamble to the PPVFR act, 2001 clearly defines the reasons for its existence viz., protection of breeders and farmers rights, accelerated agricultural development and facilitation of growth of seed industry in India. Other countries who developed sui generis systems include Thailand, Malaysia, Countries of African Union, etc.

The PPVFR act, 2001, empowers the Government of India to create a legal and governance framework for protection of plant varieties including transgenic plant varieties and a benefit sharing mechanism to reward plant breeders and farmers. Accordingly the PPVFR authority, an independent institution has been established for this purpose, which registers plant varieties and also fixes benefit or royalty for the breeder and farmers in line with article 26 of the act.

India has consciously chosen to keep plants, varieties and seeds outside of the Patent Act by inserting Section 3(j) in the Indian Patent Act (IPA), 1970 under category of inventions which cannot be patented.

Though both the IPR enactments provide protection to the innovators, there are certain subtle differences between the provisions of these Acts.The differences between the provisions of PPVFR Act and the Patent Act are as follows.

PPVFRA IPA
Covers plant varieties and seeds as per the definition Excludes plant varieties and seeds
Registration of a variety provides an exclusive right to the breeder Patent gives a right to exclude others of its usage
The criteria for registration of a new plant variety are Novelty, Distinctiveness, Uniformity and Stability (NDUS) The criteria of an invention are patentability involve Novelty, Industrial use and Inventive step or Patentability.
Section 30 gives a right to use a registered (protected) variety for developing new varieties which become eligible for registration and thereby exclusive marketing rights.

 

However, the right is subject to an obligation for a benefit sharing with the trait developer under Section 26

No such provisions

 

The provisions of the PPVFRA cannot give monopoly for a GM trait. In countries like USA where transgenic plant varieties are patentable, the trait developer can have a monopoly on the trait and thereby can control all the new varieties developed by other breeders. This is the importance difference between the IPA compared to USA.
The benefit share (trait value) to be determined by the Authority based on the claims made by the trait developer and after hearing the stakeholders like farmers, breeders etc., The trait value can be decided by the trait developer on their own.

Despite above differences, the PPVFR act provides a comprehensive framework by rewarding developers of plant varieties with both IPR protection and also benefits fixed by authority after assessment of claims. All in all, it is a win-win for the farmers and the Indian seed industry.
