சென்னை: இதுகுறித்து நிருபர்களுக்கு, அமைச்சர் உடுமலை ராதா கிருஷ்ணன் அளித்த பேட்டி வருமாறு:-

சென்னை சில்க்ஸ் கட்டிடத்தில் தீவிபத்து ஏற்பட்டதால், அந்த கட்டிடத்தின் நிலைப்பாடு தொடர்பாக சில கருத்துகளை கூறவேண்டியதுள்ளது. 2000-ம் ஆண்டில் வணிக வளாகம் கட்டுவதற்காக சென்னை பெருநகர வளர்ச்சிக் குழுமத்திடம் (சி.எம்.டி.ஏ.) சென்னை சில்க்ஸ் நிறுவனம் விண்ணப்பித்தது.

4 தளங்கள் கட்டுவதற்குத்தான் அனுமதி பெறப்பட்டிருந்தது. ஆனால் அதைக் கட்டும்போது 8 தளங்களாகக் கட்டிவிட்டனர். அப்படி கட்டும்போதே அவர்களுக்கு நோட்டீசு அனுப்பப்பட்டது. கட்டுமானத்தை உடனே நிறுத்தவும் ஆணையிடப்பட்டது. கட்டிட இடிப்பு நோட்டீசும் வழங்கப்பட்டிருந்தது.

 

 

 

 

 

அது அனுமதி பெறாமல் கட்டப்பட்ட கட்டிடம் என்பதை பொதுமக்களுக்கு தெரிவிப்பதற்காக பத்திரிகை விளம்பரத்தையும் சி.எம்.டி.ஏ. கொடுத்திருந்தது. இந்த நோட்டீசுகளை எதிர்த்து ஐகோர்ட்டில் சென்னை சில்க்ஸ் நிறுவனம் வழக்கு தாக்கல் செய்தது.

18.8.06 அன்று கட்டிடத்தை இடிக்கும் பணியை சி.எம்.டி.ஏ. தொடங்கியது. ஐகோர்ட்டில் அவர்கள் வழக்கு தாக்கல் செய்து தடை ஆணை பெற்றதால் இடிக்கும் பணி நிறுத்தப்பட்டது. அந்த தடையாணை பின்னர் ரத்து செய்யப்பட்டதால் அதை இடிக்கும் பணி மீண்டும் தொடங்கியது. மேல் தளங்கள் இடிக்கப்பட்டன. பின்னர் கட்டிடத்தின் ஸ்திரத்தன்மை சோதிக்கப்பட்டது. மின்சாரம், குடிநீர் இணைப்புகளை துண்டிப்பதற்கு சம்பந்தப்பட்ட துறைகளுக்கு கடிதம் எழுதப்பட்டது. கட்டிடத்தை காலி செய்யவேண்டும் என்று 25.1.2007 அன்று கடிதம் அனுப்பப்பட்டது.

இந்த நிலையில், கட்டிடங்களை வரைமுறை செய்வதற்கான அவசரச் சட்டம் கொண்டுவரப்பட்டது. பின்னர் அந்த கட்டிடம் தொடர்பான வழக்கு ஐகோர்ட்டு, சுப்ரீம் கோர்ட்டுக்கு சென்றது.

 

பின்னர் தியாகராயநகர் கட்டிடங்கள் தொடர்பாக ஐகோர்ட்டு 2011-ம் ஆண்டில் அறிக்கை கேட்டது. அதை சி.எம்.டி.ஏ., மாநகராட்சி ஆய்வு செய்து, 86 கட்டிடங்கள் விதிகளை மீறி கட்டப்பட்டு இருப்பதாக அறிக்கை தாக்கல் செய்யப்பட்டது.

அதன் பின்னர் 25 வணிக வளாகங்கள் பூட்டி ‘சீல்’ வைக்கப்பட்டன. இதில் சென்னை சில்க்ஸ் கட்டிடமும் ஒன்று. ஆனால் அவர்கள் தனிப்பட்ட முறையில் தடையாணை பெற்று, மற்ற கட்டிடங்கள் மீதும் நடவடிக்கை எடுக்க முடியாமல் செய்துவிட்டனர். 2011-ம் ஆண்டு நவம்பரில், மற்ற கட்டிடங்களையும் பூட்டி ‘சீல்’ வைக்கவேண்டும் என்று ஐகோர்ட்டு உத்தரவிட்டது.

இதை எதிர்த்து வழக்கு தொடர்ந்ததை அடுத்து, ஐகோர்ட்டின் உத்தரவை சுப்ரீம் கோர்ட்டு தள்ளுபடி செய்தது. மேலும் வழக்குதாரர்களான வர்த்தக சங்கத்தினரையும் வழக்கில் சேர்த்து தீர்ப்பளிக்கும்படி சுப்ரீம் கோர்ட்டு உத்தரவிட்டது.

மேலும் வழக்குகள் தொடரப்பட்ட நிலையில், 9.1.12 அன்று சுப்ரீம் கோர்ட்டு உத்தரவு பிறப்பித்து, கட்டிடத்தின் சீலை 6 வாரங்களுக்கு அகற்றவேண்டும் என்று உத்தரவிட்டது. எனவே, மறுநாளில் சென்னை சில்க்ஸ் கட்டிடம் உள்பட ‘சீல்’ வைக்கப்பட்ட மற்ற வணிக வளாகங்களின் ‘சீல்’ அகற்றப்பட்டது.

இந்த நிலையில், கமிட்டி அமைக்கப்பட்டது. நகர் ஊரமைப்புச் சட்டத்தில் 113 (சி) என்ற புதிய பிரிவை ஏற்படுத்தி, 1.7.07 தேதிக்கு முன்பு கட்டப்பட்ட கட்டிடங்களை வரைமுறைப்படுத்த வழிவகை செய்யவேண்டும் என்ற பரிந்துரைகளையும் வழங்கி, இடைக்காலத் தடையை ஐகோர்ட்டு நீட்டித்தது.

இந்த கட்டிடங்களில் சென்னை சில்க்ஸ் கட்டிடமும் ஒன்று. இதுபோன்ற ஐகோர்ட்டின் உத்தரவின் காரணமாகவே அந்த கட்டிடத்தின் மீதான நடவடிக்கைகள் தள்ளிவைக்கப்பட்டன. விதிமீறல் கட்டிடங்கள் மீது நடவடிக்கை எடுக்கவேண்டும் என்பதில் சி.எம்.டி.ஏ. பாரபட்சம் காட்டவில்லை.

புதிய பிரிவின்படி சில வரைமுறைகளுக்கான விதிகள் வகுக்கப்பட்டுள்ளன. அதன்படி அங்கு நடவடிக்கை எடுக்கப்படும். இந்த விஷயத்தில் நீதிபதிகள் மோகன் மற்றும் ராஜேஸ்வரன் ஆகியோர் தலைமையில் 2 குழுக்கள் அமைக்கப்பட்டன.

ஆனால் குழு அமைத்ததையும் எதிர்த்து வழக்கு தாக்கல் செய்யப்பட்டதால் இந்த பிரச்சினையில் காலதாமதம் ஏற்பட்டுள்ளது. இந்த நடவடிக்கைகளையெல்லாம் விரைவுபடுத்துவது பற்றி ஆலோசிக்கப்பட்டு வருகிறது.

சென்னை சில்க்ஸ் நிறுவனம் தனியாக வழக்கை சந்திக்காமல், விதிகளை மீறிக் கட்டப்பட்டிருந்த மேலும் 30 கட்டிட உரிமையாளர்களையும் வழக்கில் சேர்த்துக்கொண்டனர். கட்டிட விதி மீறல் விஷயத்தில் அரசு கடுமையான நடவடிக்கை எடுக்கும்.

இந்த பிரச்சினையில் அனைத்து கட்டிடங்கள் மீதும் என்னென்ன நடவடிக்கை எடுக்க வேண்டும் என்பது பற்றி முதல்-அமைச்சருடன் விரிவாக ஆலோசிக்கப்படும். இந்த விஷயத்தில் மக்களுக்கு பாதிப்பு ஏற்படாமல் என்னென்ன வரைமுறைகளைச் செய்ய முடியும் என்பது பற்றிய நீதிபதி ராஜேஸ்வரன் குழுவின் பரிந்துரைகளை ஐகோர்ட்டு ஏற்றுக்கொண்டுள்ளது.

எந்த கட்டிடங்களை இடிக்க முடியும், எதை இடிக்க முடியாது என்பதற்கு புதிய விதியில் வழிவகை செய்யப்பட்டுள்ளது. கட்டிய விஷயத்தில் எல்லா இடங்களிலும் ஒரேவிதியை அமல்படுத்துவதில் சில பிரச்சினைகள் எழுகின்றன. அதுபற்றியும் ஆலோசிக்கப்படுகிறது.
